Terms and Conditions

The agreement between you and Cloudswyft LMS covering your account, the courses you buy, and what each of us is responsible for.

Effective August 25, 2026 19 clauses Governed by Philippine law

In short: use the platform honestly, pay for the courses you enroll in, keep your account to yourself, and do not copy course material out of the site. The clauses below are the version that counts.

1Acceptance of these terms

These Terms and Conditions are an agreement between you and Cloudswyft LMS ("we", "us"). They apply every time you visit this site, create an account, or enroll in a course.

By using the platform you accept these terms. If you do not accept them, please do not use the site. If you are using the platform on behalf of an organization, you confirm that you are authorized to accept these terms for that organization.

2Who may use the platform

You may use the platform if you are at least 13 years old. If you are under 18, you need the consent of a parent or guardian, who is responsible for your use of the site and for any purchases you make.

The information you give us when registering must be accurate and kept up to date. We may refuse or close an account that we reasonably believe was opened with false information.

3Your account

  • An account belongs to one person. Do not share your login, and do not use anyone else's.
  • You are responsible for keeping your password secret and for everything done through your account.
  • Tell us immediately at our contact page if you think someone else has access to your account.
  • You can close your account at any time. Closing it does not automatically refund courses you have already bought; see Refunds and cancellations.

4Enrolling in and paying for courses

Courses on this platform are bought individually. There is no subscription and no recurring charge: you add the courses you want to your cart, pay once, and keep access to what you bought.

  • Prices are shown on each course page in the currency stated there and include any taxes we are required to collect.
  • Payment is handled by our payment provider, Paymongo. We do not see or store your full card details.
  • Your enrollment starts once payment is confirmed. If a payment fails or is reversed, we may remove access to the affected course.
  • Some courses are free. Free enrollment gives you the same access to the course material, subject to these same terms.
  • Access is for your personal, non-commercial learning unless we have agreed otherwise in writing.

5Refunds and cancellations

We want you in a course that fits. If a paid course is not what you expected, you may request a refund within 14 days of purchase, provided you have not completed more than a quarter of the course and have not been issued a certificate for it.

Request a refund through our contact page with the course name and the email address you paid with. Approved refunds go back to the original payment method, and the amount may take several business days to appear depending on your bank. We may decline refund requests that we reasonably believe are abusive, such as repeated buy-and-refund cycles on the same material.

6Course content and availability

Courses are reviewed by our staff before they are listed, but course material is written by instructors and may be updated, corrected, or reorganized while you are enrolled.

We may retire a course. If we retire a course you have paid for, we will give you reasonable notice so that you can finish it or download the material you are entitled to keep, and where that is not practical we will offer a refund or a comparable course.

We aim to keep the platform available at all times but cannot promise uninterrupted service. Maintenance, upgrades, and events outside our control can interrupt access.

7Acceptable use

When using the platform, you agree not to:

  • copy, download in bulk, resell, or republish course material;
  • share your account or course access with anyone else;
  • harass, threaten, impersonate, or discriminate against other learners or staff, in forums or anywhere else on the site;
  • post content that is unlawful, defamatory, obscene, or infringes someone else's rights;
  • upload malware, scrape the site with automated tools, probe our security, or try to gain access to systems or data that are not yours;
  • interfere with the platform's normal operation for other people.

8Academic honesty

Assessments are meant to measure your own work. Do not submit work that is not yours, do not share answers or assessment content with other learners, and do not use another person to complete a course or exam on your behalf.

Where we find that work was not honestly done, we may void the affected grades, revoke a certificate, or close the account.

9Certificates

A certificate confirms that you completed the requirements of a specific course on this platform. It is not an academic degree, and it does not carry academic credit or professional accreditation unless the course page explicitly says so.

We may revoke a certificate that was issued in error or obtained in breach of Academic honesty.

10Our intellectual property

The platform, its design, its software, and the course material on it are owned by us or by our instructors and licensors, and are protected by copyright and other laws.

Buying a course gives you a personal, non-transferable licence to access that course for your own learning while your account is in good standing. It does not transfer ownership of anything, and it does not let you teach from, distribute, or build a competing product out of the material.

11Content you submit

You keep ownership of what you post: forum contributions, assignments, profile details, and messages you send us.

By posting on the platform you give us a non-exclusive, worldwide, royalty-free licence to host, display, and distribute that content as part of running and improving the service. You confirm you have the right to post it. We may remove content that breaches these terms.

12Privacy and your data

How we collect and handle your personal data is described in our Privacy Policy, which forms part of these terms. In short: we collect what we need to run your account and your courses, and we do not sell your personal data.

13Third-party services

The platform relies on third parties, including our payment provider, and links out to sites we do not control. Those services have their own terms and privacy policies, and we are not responsible for their content or their handling of your data. Following a link is at your own risk.

14Suspension and termination

We may suspend or close an account that breaches these terms, that is used for fraud or chargeback abuse, or where we are required to act by law. Where it is reasonable to do so, we will tell you why and give you a chance to put things right first.

If we close your account for a breach, you may lose access to courses you have paid for without a refund. If we close it for any other reason, you keep your refund rights under Refunds and cancellations.

15Disclaimers

The platform and its course material are provided "as is". We do not promise that a course will lead to a job, a promotion, a qualification, or any particular result, and we do not warrant that the material is free of errors or that the site will always be available or secure.

Nothing in these terms excludes any right you have under consumer protection law that cannot legally be excluded.

16Limitation of liability

To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost opportunities, or loss of data arising from your use of the platform.

Where we are found liable, our total liability to you is limited to the amount you paid us for the course the claim relates to during the twelve months before the claim arose.

17Changes to these terms

We may update these terms as the platform changes or as the law requires. When we do, we will change the effective date at the top of this page, and for material changes we will give notice on the site or by email before they take effect.

Continuing to use the platform after a change takes effect means you accept the updated terms. Changes never apply retroactively to a course you have already bought.

18Governing law

These terms are governed by the laws of the Republic of the Philippines, and the courts of the Philippines have jurisdiction over any dispute arising from them. If any clause is found unenforceable, the rest stays in force.

19How to reach us
